Join us on February 2nd to discuss the EPA’s and the Army Corps’ January 2023 rulemaking trying to establish a “durable” definition for “waters of the United States,” and what their next rulemaking steps might be.

The Houston-Conroe-Galveston region is wet, and there are creeks, ditches, wetlands, and soggy ground all over the place. We are well into a multi-decade saga over just how many of these wet areas, including those on private property, are subject to federal jurisdiction.

The Clean Water Act gives the government authority over “navigable waters,” defined not very helpfully as “waters of the United States, including the territorial seas.” Join us for an engaging discussion on:
• How the Supreme Court’s pending decision in United States v. Sackett (decision expected this spring) may affect the reach of federal jurisdiction
• Fallout from the vacatur of the Trump-era definition of “waters of the United States,” and what that has meant for many Approved Jurisdictional Determinations in the Army Corps’ Galveston District
